Nest Navigate™ Terms & Conditions

1. Services

Nest Navigate provides gamified homebuyer education modules and issues Nest Coins™ rewards. Services may be modified, suspended, or discontinued at any time without liability.

2. Rewards

• Nest Coins™ currently have no cash value but may be in the future and are non-transferable.
• At Nest Navigate's sole discretion, Nest Coins™ may in the future be exchangeable for currency or other services. No present right or guarantee exists.
• Partner offers and rewards are fulfilled by third parties. Nest Navigate is not liable for partner products or services.

3. User Responsibilities

• You must be 18+ and provide accurate account information.
• You agree not to misuse the Services, including by fraud, hacking, scraping, or reverse engineering.
• You are responsible for safeguarding your account credentials.

4. Data Use & Monetization

• By using the Services, you grant Nest Navigate a perpetual, worldwide, irrevocable license to collect, use, analyze, sell, share, license, and otherwise monetize your personal, transactional, behavioral, and technical data.
• Data may be retained, shared, and monetized even after account termination or deletion, as permitted by law.
• You will not receive compensation for Nest Navigate's use of data.

5. Privacy Rights (CCPA/CPRA and Similar State Laws)

• If you are a California resident (or live in a state with similar laws), you have rights described in our Privacy Policy, including:
  • Right to know/access, delete, and correct personal information.
  • Right to opt out of sale/sharing and limit use of sensitive personal information.
  • Users may exercise their rights via the 'Do Not Sell or Share My Personal Information' link on our platform.

6. Data Requests & Timing

Verified consumer requests will be processed within 45 days, with one possible 45-day extension if reasonably necessary. Requests may be denied if repetitive or conflicting with legal obligations.

7. Competitor Use Prohibited

You may not access or use Nest Navigate's Services if you are a Competitor. "Competitor" includes any entity developing or offering products similar to Nest Navigate's platform or business model. Accounts found to be operated by Competitors may be terminated immediately, and Nest Navigate may pursue legal remedies including injunctive relief and recovery of all legal costs.

8. Competitor Liability

Any Competitor who violates these Terms shall be liable for all damages, losses, and expenses (including attorneys' fees) incurred by Nest Navigate. Competitor agrees to indemnify Nest Navigate regardless of the outcome of any proceeding.

9. Notice & Cure Requirement

Before initiating arbitration or legal claims, you must provide Nest Navigate with written notice at eric@nestnavigate.com. Nest Navigate shall have thirty (30) days to resolve the matter. This is a mandatory condition precedent to any legal proceeding.

10. SMS & Mobile Messaging Terms

By opting into Nest Navigate's SMS program, you expressly consent to receive recurring automated marketing and educational text messages (including via automatic telephone dialing systems) at the number provided.

• No Condition of Purchase: Consent to receive marketing text messages is not a condition of purchase or a requirement to use the Nest Navigate Services.
• Opt-Out: You may opt out at any time by texting STOP to any message received. You will receive one final text confirming your unsubscribed status.
• Help: Text HELP for assistance or email support@nestnavigate.com.
• Rates & Frequency: Message and data rates may apply. Message frequency varies based on user activity and rewards.
• Carriers: Mobile carriers are not liable for delayed or undelivered messages.

11. Email & General Communications

By creating an account, you consent to receive email communications, mail, and in-app notifications regarding educational content, rewards, and offers. You may opt out of marketing emails at any time using the unsubscribe link provided in the email or by contacting privacy@nestnavigate.com.

12. Third-Party Messaging & Conduct

Users may communicate with third parties (Realtors, MLOs, etc.) through our platform. Nest Navigate is not responsible for the content, promises, or conduct of these third parties. You agree to indemnify Nest Navigate against claims arising from your interactions with other users or third-party service providers.

13. Educational Content & Disclaimers

No Professional Advice. Content is for general educational purposes only and does not constitute legal, financial, tax, or real estate advice. Nest Navigate is not a broker or lender. Use of the Services is at your own risk.
